Article 1 - Definitions

In these general terms and conditions, the following definitions apply:

• Farmoxa: The company Farmoxa, located at Tinstraat 22N, 2984 AN Ridderkerk
• Customer: The natural or legal person entering into an agreement with Farmoxa
• Products: All irrigation and agricultural products offered by Farmoxa
• Agreement: The purchase agreement between Farmoxa and the customer

Article 2 - Applicability

These general terms and conditions apply to all offers, orders, and agreements between Farmoxa and the customer.

Deviations from these terms are only valid if expressly agreed upon in writing.

Article 3 - Offers and Prices

3.1 All offers are non-binding, unless stated otherwise.

3.2 The prices stated on our website are in euros, including VAT and excluding shipping costs, unless otherwise indicated.

3.3 Farmoxa reserves the right to change prices. Price changes do not affect orders already placed.

3.4 Obvious errors or mistakes in offers are not binding on Farmoxa.

Article 4 - Formation of the Agreement

4.1 The agreement is concluded when the customer places an order and Farmoxa confirms this order.

4.2 Farmoxa reserves the right to refuse orders or to attach conditions to the delivery.

4.3 The customer will receive an order confirmation by e-mail.

Article 5 - Delivery

5.1 Farmoxa aims to deliver orders within the indicated delivery time.

5.2 The delivery time is 2-3 working days, unless otherwise indicated.

5.3 In case of exceeding the delivery time, the customer has the right to dissolve the agreement, unless the delay is not attributable to Farmoxa.

5.4 The risk of loss or damage passes to the customer at the time of delivery.

Article 6 - Payment

6.1 Payment must be made via the payment methods offered on the website.

6.2 In case of late payment, the customer is in default, and Farmoxa is entitled to charge statutory interest.

6.3 Farmoxa reserves the right to demand prepayment.

Article 7 - Right of Withdrawal

7.1 The customer has the right to withdraw from the agreement within 30 days after receiving the product.

7.2 The product must be returned unused and in its original packaging.

7.3 The costs for return shipment are for the customer's account, unless the product is defective or does not match the order.

7.4 After approval of the return, the purchase amount will be refunded within 14 days.

Article 8 - Warranty and Conformity

8.1 Farmoxa guarantees that the products comply with the agreement and with the generally accepted standards of soundness.

8.2 In the event of defects arising within the warranty period, Farmoxa will repair or replace the product free of charge.

8.3 The warranty expires in case of improper use or modifications to the product by the customer.

Article 9 - Liability

9.1 Farmoxa is not liable for indirect damages, including consequential damages, loss of profit, and missed savings.

9.2 The liability of Farmoxa is limited to the amount of the order.

9.3 Farmoxa is not liable for damage resulting from incorrect use of the products.

Article 10 - Force Majeure

10.1 Farmoxa is not obliged to fulfill any obligation if it is prevented from doing so by force majeure.

10.2 Force majeure includes: war, riots, mobilization, domestic and foreign unrest, government measures, strikes, lockouts, business disruptions, fire, explosion, and other serious disruptions in Farmoxa's business operations.

Article 11 - Intellectual Property

11.1 All intellectual property rights relating to the website and products belong to Farmoxa.

11.2 It is not permitted to reproduce or disclose information from the website without prior written permission from Farmoxa.

Article 12 - Applicable Law and Disputes

12.1 All agreements between Farmoxa and the customer are governed by Dutch law.

12.2 Disputes will be submitted to the competent court in the district where Farmoxa is located.

Article 13 - Amendment of Terms

Farmoxa reserves the right to amend these general terms and conditions. The most recent version can always be found on our website.
